O Supremo Tribunal Federal (STF) confirmou nesta quarta-feira (22) a validade da reestrutura\u00e7\u00e3o do Grupo de Atua\u00e7\u00e3o Especializada de Combate ao Crime Organizado (Gaeco), n\u00facleo respons\u00e1vel pela atua\u00e7\u00e3o em investiga\u00e7\u00f5es criminais. Por unanimidade, a Corte reafirmou o poder de investiga\u00e7\u00e3o do Minist\u00e9rio P\u00fablico e validou uma resolu\u00e7\u00e3o interna do Minist\u00e9rio P\u00fablico do Estado do Rio de Janeiro (MP-RJ) que reestruturou o Gaeco do \u00f3rg\u00e3o.\u00a0\u00a0<\/strong><\/p>\n

Em 2023, a Corte julgou a constitucionalidade da resolu\u00e7\u00e3o e reafirmou o poder de investiga\u00e7\u00e3o do Minist\u00e9rio P\u00fablico, a partir de uma a\u00e7\u00e3o protocolada pela Associa\u00e7\u00e3o dos Delegados de Pol\u00edcia do Brasil (Adepol). A entidade alegou que somente as pol\u00edcias federal e civil t\u00eam a prerrogativa de realizar investiga\u00e7\u00f5es criminais, mas o plen\u00e1rio validou a participa\u00e7\u00e3o do MP em investiga\u00e7\u00f5es.<\/p>\n

Ap\u00f3s o julgamento, a Adepol apresentou um recurso para esclarecer que o poder de investiga\u00e7\u00e3o do Minist\u00e9rio P\u00fablico deve ser seguir par\u00e2metros que foram definidos em julgamentos anteriores sobre a quest\u00e3o.<\/p>\n

Por unanimidade, os ministros aceitaram o recurso da entidade e esclareceram que as investiga\u00e7\u00f5es conduzidas pelo Minist\u00e9rio P\u00fablico devem depender de autoriza\u00e7\u00e3o judicial, seguir prazos estabelecidos na legisla\u00e7\u00e3o penal e observar os direitos constitucionais dos investigados.<\/strong><\/p>\n

Em 2015, o Supremo reconheceu que o MP tem compet\u00eancia para exercer investiga\u00e7\u00f5es criminais. A quest\u00e3o foi decidida em um caso concreto, no qual um ex-prefeito, denunciado por crime de responsabilidade, questionou investiga\u00e7\u00e3o conduzida exclusivamente pelo \u00f3rg\u00e3o, sem participa\u00e7\u00e3o da pol\u00edcia.\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"
